The Hon Dr Andrew Leigh MP, Assistant Minister for Competition, Charities and Treasury in the Albanese government, is convinced that the law governing the enforcement of post-employment restrictive covenants is suppressing competition and innovation in the Australian economy. He is driving a review of the law, and if Australia follows developments in the United States, we are likely to see reforms in the near future. This ‘explainer’ outlines the problem, as it is perceived in the government’s Competition Review Issues Paper, and indicates potential law reforms.
